What data we store, we will protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification. You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some or all of the Services. Your continued use of our Services will be regarded as acceptance of our practices around privacy and personal information.

1. Description of the Services

Songoven creates, through various Affiliated Artists, customized songs and other musical creations for personal use of our customers, using specifications and details provided by our customers, all pursuant to the Terms of Use (the “Terms”). The use of the Songoven website for browsing, as well as ordering a Song, with or without having an active User Account (whether through gift cards, referral links, or otherwise) are, collectively, the “Services”.

 

2. General Information Collected

Usage and Log Information: We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services), log files, and diagnostic, crash, website, and performance logs and reports. We also collect use data collection tags or directives, such as "pixel tags" "clear gifs" JavaScript scrips, API calls or similar means.

Device and Connection Information: We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network information, and device identifiers. We may collect device location information for security, diagnostics and troubleshooting purposes.

Cookies: We use cookies to operate and provide our Services, including to provide our Services that are web-based, improve your experiences, understand how our Services are being used, and customize our Services. For example, we use cookies to provide Songoven for web and desktop and other web-based services. Additionally, we may use cookies to remember your choices, such as your order submission preferences, and otherwise to customize our Services for you.

Third Party Advertisement Data: We may display ads on our Site of third party vendors, or we may place ads of Songoven on other platforms. In doing so, we may use the services of agencies or providers who may employ cookies or other types of use tracking methods, using anonymous and general data. You may be granted the possibility of opting out of advertising or cookies (depending on the party used for the service). It may be possible that such advertising agencies will use flash cookies to collect and store information. Flash cookies may defer from browser cookies and cookie management offered by your browser will not remove flash cookies.

 

3. Personal Information Collected

​​​​​​​In order to purchase a Song, you must register for and maintain an active User Account (the "User Account"). Registration for a User Account requires that you submit your email address to Songoven, and verify the validity of the email. A change in your email address may result in your inability to access or use the Services. We may ask that you provide information about your name, mailing or billing address, gender, age, and other personal information. You may access the settings of your User Account to add or modify your Personal Information. ​​​​​​​

Payment information may be taken from you upon the submission of an order, including address, credit card information and other relevant data required to process your order. ​​​​​​​

Third Party Information. We offer a referral program which encourages you to refer your friends to our Site and enjoy the benefits of our products. We also offer the ability to purchase gift cards for your loved-ones. In doing so, you will be required to give us information (name, email) of the person you are referring to us or to whom you are buying a gift card. ​​​​​​​

Song-related information. When you make an order to purchase a Song you may provide information about the subject of your Song such as their name, their picture, traits or other relevant information used to create the Song.​​​​​​​

You may be required to provide additional personal information and/or provide proof of identity or other method of identity verification to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide such information or proof of identity or other method of identity verification.

 

4. Use of Information

​​​​​​​Personal Information: Songoven uses the personal information you provide to process your orders, fulfill your requests, communicate with you about your orders, and provide customer support. We may also use this information to improve our products and services, and to send you marketing communications or promotional offers.​​​​​​​

General Information: The non-personal information we collect is used to analyze trends, administer the Website, track user movement, and gather demographic information for internal purposes. This information helps us understand how our customers use our Website and enables us to enhance user experience. We do not link General Information to any Personal Information. We may use the General Information, as well as the demographic and psychografic data we collected, and analyze it (whether directly or through partnerships with third-party providers). The analysis helps us to understand use patterns and helps us create customized promotional materials and programs which are personalized and which are more likely to generate favorable response. ​​​​​​​

Both Personal and General Information may be used by us for the following additional uses:

5. Privacy Policy

The Policy herein applies to all general information collected pursuant to Section ‎2 above ("General Information"), as well as personal information collected pursuant to Section ‎3 above ("Personal Information").​​​​​​​

You are hereby made aware and expressly agree that ALL OF YOUR ACTIVITY ON THE USER ACCOUNT MAY BE LOGGED AND STORED, AND ALL INFORMATION MAY BE DISCLOSED TO SONGOVEN AND OTHER PARTIES AS SPECIFIED HEREIN. ​​​​​​​

Except as otherwise provided herein, Personal Information shall remain undisclosed to any person, subject, however, to Songoven's permission to publish the Song (which will include the Personal Information included in Section ‎3.3) and the "change of control" exception below. ​​​​​​​

Change of Control: Notwithstanding the foregoing, Songoven is permitted to transfer, sell or otherwise dispose of any Personal Information provided by you to any bona fide purchaser of its business activities and/or assets and/or shares, as well as in connection with any merger or other re-organization process and/or in bankruptcy. If material changes to the privacy policy information will be made as a result of such transfer, a notice of same will be delivered to you.

Legal Compliance: Notwithstanding the foregoing, Songoven may disclose any information it has about you (General as well as Personal Information) if it determines that such disclosure is necessary in connection with any inquiry, investigation, or complaint regarding the use of the Services, or to identify, contact or bring legal action against someone who may have made use of the Services and/or who may have caused damage, injury to or interference with (either intentionally or unintentionally) any right or property belonging to Songoven, the Affiliated Artist, or any third party. Songoven reserves the right at all times to disclose any information that Songoven deems necessary to comply with any applicable law, regulation, legal process or governmental request. Songoven also may disclose your information when Songoven determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.​​​​​​​

Service Providers: Songoven may share your Personal and General Information with third-party providers who assist us in operating our business, such as Affiliated Artists, payment processors, shipping providers and customer support services. These service providers have access to your personal information only to perform specific tasks on our behalf and are obligated to maintain confidentiality and security of your information. ​​​​​​​

Songoven may preserve any communication between you and Songoven, and may disclose such data if required to do so by law or if Songoven determines that such disclosure is necessary to (1) comply with legal process, (2) enforce its Terms, (3) respond to any claims, or (4) protect the rights, property or personal safety of Songoven, its employees, clients, users of the Site, the Affiliated Artists, and the public.​​​​​​​

Financial Data: We use the financial data you provide to process your transactions, complete payment and deliver the products or services you have purchased. We may also use this information to detect and prevent fraudulent activities and ensure compliance with legal and regulatory requirements. ​​​​​​​

Third Party Information: Any third party who receives emails from us because of information you gave to us either for the referral program or because you purchased a gift card, will be given the option to remove his/her information from our Site, if they so desire. ​​​​​​​

Children's Privacy: Songoven is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have collected personal information from a child, please contact us, and we will take appropriate steps to remove the information from our records.

Data Security. Songoven implements industry standard security measures to protect the Information we collect. However, no method of transmission or storage can guarantee absolute security. We strive to use commercially acceptable means to protect your Information but cannot guarantee its absolute security.

Updates To Our Policy. We may amend or update our Privacy Policy. We will provide you notice of amendments to this Privacy Policy, as appropriate, and update the “Last Modified” date at the top of this Privacy Policy. Your continued use of our Services confirms your acceptance of our Privacy Policy, as amended. If you do not agree to our Privacy Policy, as amended, you must stop using our Services. Please review our Privacy Policy from time to time.

Third Party Links: As provided in our General Terms of Use, clicking upon a link to a third party provider's external site or page redirects you to a third party's site and thereupon this Privacy Policy regarding the information you provided to us will no longer apply. You are encouraged to review the privacy policy of any third-party linked site independently and ensure that your Personal Information is protected by such third party. Songoven is not responsible for any use of your Information by a third party provider, irrespective of the fact that you were re-directed to such person by "clicking" a link provided on Songoven's Site.
